
The Central Board of Indirect Taxes and Customs (CBIC), through Circular F. No. C-50/94/2024-Ad.II dated 09 June 2026, has issued detailed instructions for strengthening the monitoring and management of court cases relating to service matters of CBIC officers. To ensure effective oversight of litigation and timely departmental response, the Board has mandated that all field formations and concerned divisions obtain a Note on Proceedings (NoP) from the Government Counsel on the date of every court hearing.
The circular requires that the NoP be obtained by the evening of the hearing date and placed before the concerned senior officers for review. A copy must also be forwarded to the relevant Board Division on the next working day. The NoP is required to capture key aspects of the hearing, including significant observations made by the Court, directions issued, the next date of hearing, documents or clarifications required by the Government Counsel, and recommendations regarding the future course of action. The Board has further directed that any development requiring urgent departmental intervention should be specifically highlighted to facilitate prompt decision-making. To ensure accountability, all Government Counsels have been instructed to furnish the NoP on the same day of the hearing, and the circular emphasizes that any deviation from these instructions will be viewed seriously.
